A BILL FOR AN ACT ENTITLED: "AN ACT ALLOWING CAPITOL SECURITY PERSONNEL AND GUARDS TO HAVE A VEHICLE REMOVED FROM THE CAPITOL COMPLEX AND CONTIGUOUS AREAS UNDER CERTAIN CONDITIONS; AND AMENDING SECTION 2-17-816, MCA."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     Section 1.  Section 2-17-816, MCA, is amended to read:

     "2-17-816.  Parking citations and vehicle removal within capitol complex. (1) The director of the department of administration may in his discretion enter into an agreement with the city of Helena, Montana, to authorize capitol security personnel and security guards employed by the department to issue citations for parking violations as defined by state or municipal laws which that occur within the boundaries of the capitol complex or on streets or alleys contiguous thereto to the capitol complex. All such citations must be considered within the jurisdiction of the city of Helena, Montana, and must be handled in the same manner as citations issued by peace officers thereof of the city.

     (2) A vehicle located in the capitol complex or on a street or alley contiguous to the capitol complex that is found to be obstructing fire lanes or hydrants, handicapped parking spaces, traffic flow, or access to a parking area may be removed at the vehicle owner's expense."
