A JOINT RESOLUTION OF THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE STATE OF MONTANA REQUESTING A STUDY OF USING EARMARKED STATE REVENUE TO FUND STATE PROGRAMS AND THE DEVELOPMENT OF LEGISLATION TO EVENTUALLY PHASE OUT THE USE OF EARMARKED STATE REVENUE, WHEN APPROPRIATE.
WHEREAS, the Legislature has from time to time enacted programs dependent on specially earmarked revenue sources for funding; and
WHEREAS, this designation of earmarked revenue has been used as a justification for the existence of some programs; and
WHEREAS, programs should be considered by the Legislature based on the programs' merit and according to principles of sound public policy rather than according to whether a particular revenue source can be tapped to fund the program.
NOW, THEREFORE, BE IT RESOLVED BY THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE STATE OF MONTANA:
That the Legislative Finance Committee, with any staff support from the Legislative Services Division considered appropriate by the Legislative Council, be requested to:
(1) identify state programs funded with earmarked state revenue;
(2) analyze options and develop recommendations for phasing out the use of earmarked revenue to fund the programs, when appropriate; and
(3) develop legislation to implement the recommendations.
BE IT FURTHER RESOLVED, that all aspects of the study, including presentation and review requirements, be concluded prior to September 15, 2002.
BE IT FURTHER RESOLVED, that the final results of the study, including findings, recommendations, and legislation, be reported to the 58th Legislature.
