A BILL FOR AN ACT ENTITLED: "AN ACT IMPOSING AN ADDITIONAL 6-MILL LEVY FOR SUPPORT OF THE MONTANA UNIVERSITY SYSTEM; PROVIDING THAT THE PROPOSED ACT BE SUBMITTED TO THE QUALIFIED ELECTORS OF MONTANA; AMENDING SECTION 6, CHAPTER 408, LAWS OF 1999; AND PROVIDING AN EFFECTIVE DATE, A RETROACTIVE APPLICABILITY DATE, AND A TERMINATION DATE."
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:
Section 1. Section 15-10-107, MCA, is amended to read:
"15-10-107. (Temporary) Tax levy for university system. Subject to the provisions of 15-10-420, there is levied upon
the taxable value of all real estate and personal property subject to taxation in the state of Montana 6 12 mills or so much of
6 12 mills as is necessary to raise the amount appropriated by the legislature from the state special revenue fund for the
support, maintenance, and improvement of the Montana university system, as provided in referendum measure No. 113,
passed by a vote of the people at the general election held November 3 5, 1998 2002. The funds raised from the levy must be
deposited in the state special revenue fund. (Terminates January 1, 2009 2012--sec. 6, Ch. 408, L. 1999.)"
Section 2. Section 6, Chapter 408, Laws of 1999, is amended to read:
"Section 6. Termination. [Section 1] terminates January 1, 2009 2012."
NEW SECTION. Section 3. Effective date. This act is effective on approval by the electorate.
NEW SECTION. Section 4. Retroactive applicability. [Section 1] applies retroactively, within the meaning of 1-2-109, to tax years beginning after December 31, 2001.
NEW SECTION. Section 5. Termination. [Section 1] terminates January 1, 2012.
NEW SECTION. Section 6. Submission to electorate. This amendment shall be submitted to the qualified electors of Montana at the general election to be held in November 2002 by printing on the ballot the full title of this act and the following:
[] FOR imposing an additional 6-mill levy for support of the university system.
[] AGAINST imposing an additional 6-mill levy for support of the university system.
