A BILL FOR AN ACT ENTITLED: "AN ACT AUTHORIZING THE GOVERNOR BY EXECUTIVE ORDER TO EXTEND FOR UP TO 26 WEEKS UNEMPLOYMENT INSURANCE BENEFITS FOR A MONTANA EMPLOYEE WHO IS TEMPORARILY LAID OFF BY AN EXPERIENCED RATED MONTANA EMPLOYER IDENTIFIED IN THE EXECUTIVE ORDER AND WHO HAS EXHAUSTED UNEMPLOYMENT INSURANCE BENEFITS; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE AND AN APPLICABILITY DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Authorization to governor to extend unemployment benefits for Montana employees -- eligibility -- benefits chargeable to employer. (1) Subject to the provisions of subsections (2) and (3), the governor by executive order may extend for up to 26 weeks the benefits of a Montana employee who is temporarily laid off from employment by an experienced rated Montana employer and who has exhausted the benefits authorized by 39-51-2204.

     (2) For an employee to receive the additional benefits provided in subsection (1), the governor within the executive order shall identify each experienced rated Montana employer by name and location and each employee of the identified employer must be otherwise eligible for benefit payments under the provisions of the unemployment insurance laws.

     (3) The additional benefits provided under this section must be paid from the unemployment insurance fund, established in 39-51-401, and are chargeable to the identified employer within the meaning of Title 39, chapter 51, part 12.

 

     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 39, chapter 51, part 25, and the provisions of Title 39, chapter 51, part 25, apply to [section 1].

 

     NEW SECTION.  Section 3.  Effective date -- applicability. [This act] is effective on passage and approval and applies to employees of experienced rated Montana employers who exhaust unemployment benefits on or after [the effective date of this act].
