A BILL FOR AN ACT ENTITLED: "AN ACT PROVIDING THAT BENEFITS MUST BE PAID TO AN INSURED UNDER A MOTOR VEHICLE LIABILITY POLICY WITHOUT REGARD TO WHO IS AT FAULT; AND PROVIDING AN APPLICABILITY DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Benefits to be paid without regard to fault -- each person's insurer to pay for that person's loss. Benefits for each type of coverage must be paid under a motor vehicle liability policy without regard to fault. Each insured person's insurer shall pay that insured person for any type of loss and pay benefits under any type of coverage provided by that insured person's policy without regard to the fault of that insured person or any other person.

 

     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 33, chapter 23, part 2, and the provisions of Title 33 apply to [section 1].

 

     NEW SECTION.  Section 3.  Applicability. [This act] applies to motor vehicle liability insurance policies issued or renewed after [the effective date of this act].
