A BILL FOR AN ACT ENTITLED: "AN ACT PROVIDING FOR ANNUAL INFLATION-RELATED ADJUSTMENTS TO THE STATE'S MINIMUM WAGE; AMENDING SECTION 39-3-409, MCA; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE AND AN APPLICABILITY DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Annual inflation-related adjustments to minimum wage. (1) The commissioner shall:

     (a) determine the inflation factor for the fiscal year by dividing the consumer price index for July 1 of the current fiscal year by the consumer price index for July 1 of the prior fiscal year; and

     (b) adjust the minimum wage rates, adopted by the commissioner under 39-3-409, by the inflation factor determined in subsection (1)(a) for the ensuing fiscal year.

     (2) For the purposes of this section, "consumer price index" means the consumer price index for all urban consumers, United States city average, all items, for the base period 1982-84 = 100, as published by the bureau of labor statistics of the United States department of labor.

 

     Section 2.  Section 39-3-409, MCA, is amended to read:

     "39-3-409.  Adoption of minimum wage rates -- exception. (1) The commissioner shall adopt rules to establish a minimum wage that, except as provided in subsection (2), must be the same minimum hourly wage rate as provided under the federal Fair Labor Standards Act of 1938 (29 U.S.C. 206(a)(1)), excluding the value of tips received by the employee and the special provisions for a training wage, and that must be adjusted annually for inflation according to the provisions of [section 1].

     (2)  The minimum wage rate for a business whose annual gross sales are $110,000 or less is $4 an hour."

 

     NEW SECTION.  Section 3.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 39, chapter 3, part 4, and the provisions of Title 39, chapter 3, part 4, apply to [section 1].

 

     NEW SECTION.  Section 4.  Effective date -- applicability. [This act] is effective on passage and approval and applies to wages paid on or after July 1, 2003.
