A BILL FOR AN ACT ENTITLED: "AN ACT PROVIDING THAT COMMON LAW MARRIAGES ARE NOT RECOGNIZED IN MONTANA; AMENDING SECTION 40-1-403, MCA; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     Section 1.  Section 40-1-403, MCA, is amended to read:

     "40-1-403.  Validity of declarations of marriage -- common-law marriage not recognized. Common-law marriages are not invalidated by this chapter recognized in Montana. Declarations of marriage pursuant to 40-1-311 through 40-1-313, 40-1-323, and 40-1-324 are not invalidated by this chapter."

 

     NEW SECTION.  Section 2.  Effective date. [This act] is effective on passage and approval.
