A BILL FOR AN ACT ENTITLED: "AN ACT PROVIDING PENALTIES FOR THE LATE FILING OF CAMPAIGN FINANCE REPORTS."
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:
NEW SECTION. Section 1. Penalties for late filing of reports. (1) If a candidate or treasurer of a candidate files a campaign finance report required pursuant to 13-37-225 and 13-37-226 late, the candidate is subject to the penalties provided for in this section.
(2) (a) If the report is filed 2 or more weeks late but less than a month late, the candidate shall pay a $50 fine, which must be paid to the commissioner's office and deposited in the general fund, and must be warned by the commissioner of the penalties under subsection (2)(b).
(b) If the report is a month or more late and the filing deadline occurs:
(i) before the ballot is certified, provisions of 13-37-126 apply and the candidate's name may not appear on the official ballot for the election;
(ii) after the certification of the ballot but before the election, the candidate shall withdraw and the vacancy must be filled as provided by law;
(iii) on or after the election and the candidate is declared the winner, the candidate may not accept the certificate of nomination or election. If the candidate has already accepted the certificate of nomination or election, the candidate shall withdraw or resign from the nomination or office and the vacancy must be filled as provided by law.
NEW SECTION. Section 2. Codification instruction. [Section 1] is intended to be codified as an integral part of Title 13, chapter 37, part 2, and the provisions of Title 13, chapter 37, part 2, apply to [section 1].
