A BILL FOR AN ACT ENTITLED: "AN ACT REQUIRING QUARTERLY EMISSION TESTING FOR SOLID WASTE BURNERS; REQUIRING NOTICE OF AN EMISSION TESTING DATE; AND REQUIRING REPORTING OF EMISSION TEST RESULTS."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Emission monitoring -- reporting. A person holding a permit issued pursuant to 75-2-218 for burning solid waste shall:

     (1) monitor emissions at least quarterly for emissions, including but not limited to lead, mercury, and dioxins;

     (2) notify the department of the date that an emission test will be conducted 2 weeks prior to the test date;

     (3) provide documentation that materials burned on the test date included a representative sample of materials burned at the operation throughout the year; and

     (4) provide results of the tests required under subsection (1) and the documentation required by subsection (3) to the department within 60 days of the emission test date.

 

     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 75, chapter 2, part 2, and the provisions of Title 75, chapter 2, part 2, apply to [section 1].
