A BILL FOR AN ACT ENTITLED: "AN ACT PROVIDING THAT IF A CONVICTION OF A FELONY OFFENSE OR A YOUTH COURT ADJUDICATION OF A YOUTH FOR A SEXUAL OR VIOLENT OFFENSE IS REVERSED, THE DEPARTMENT OF JUSTICE SHALL DESTROY THE BIOLOGICAL SAMPLE THAT THE PERSON WAS REQUIRED TO PROVIDE; AND AMENDING SECTION 44-6-107, MCA."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     Section 1.  Section 44-6-107, MCA, is amended to read:

     "44-6-107.  Expungement of DNA records. If a conviction of a felony offense or the youth court adjudication of a youth for a sexual or violent offense is reversed, the record relating to the offense must be expunged from the DNA identification index and the department shall destroy the biological sample. The county attorney of the county in which the conviction or youth court adjudication occurred shall notify the department of a the reversal of a the conviction for the offense or youth court adjudication."
