A BILL FOR AN ACT ENTITLED: "AN ACT EXEMPTING LEGISLATIVE PAGES FROM INCLUSION ON THE LEGISLATIVE BRANCH PAYROLL ROSTER; PROVIDING FOR PAYMENT OF A CIVICS TRAINING FEE TO PAGES DURING A LEGISLATIVE SESSION; AMENDING SECTIONS 2-18-404 AND 5-2-221, MCA; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     Section 1.  Section 2-18-404, MCA, is amended to read:

     "2-18-404.  Payroll roster -- changes certified by appointing powers. (1) (a) The department of administration shall establish and maintain a payroll roster of all persons employed by every state agency and may establish and maintain a roster of all established positions. The Except as provided in subsection (1)(b), the payroll roster must include exempt employees and may include emergency appointees or the equivalent.

     (b) The payroll roster for the legislative branch is not required to include pages employed during a legislative session. Legislative pages are paid pursuant to 5-2-221.

     (2)  Each appointing power shall correctly and promptly certify to the department all changes, modifications, additions, and deletions to the payroll roster in compliance with all applicable merit service, fiscal, and other pertinent laws and rules.

     (3)  The state central payroll system must disburse or otherwise act in reliance upon all payroll roster certifications and attendance reports certified to the department by the respective appointing powers."

 

     Section 2.  Section 5-2-221, MCA, is amended to read:

     "5-2-221.  Officers and employees of the senate and house of representatives. (1) The officers of the senate include a president, a president pro tempore, a majority floor leader, a minority floor leader, a majority whip, and a minority whip.

     (2)  The officers of the house of representatives include a speaker, a speaker pro tempore, a majority floor leader, a minority floor leader, a majority whip, and a minority whip.

     (3)  The president and president pro tempore of the senate and the speaker and speaker pro tempore of the house shall must be elected by the house of which they are a member.

     (4)  The majority floor leader, minority floor leader, majority whip, and minority whip of the senate and house shall must be elected by their respective caucuses.

     (5)  A secretary of the senate, sergeant at arms, and chaplain shall must be appointed by the president subject to confirmation by the senate, and a chief clerk of the house, sergeant at arms, and chaplain shall must be appointed by the speaker subject to confirmation by the house.

     (6) Legislative pages who serve during a legislative session are entitled to a civics training fee of $50 for each legislative day served."

 

     NEW SECTION.  Section 3.  Effective date. [This act] is effective on passage and approval.
