SENATE BILL NO. 107

A BILL FOR AN ACT ENTITLED: "AN ACT DIRECTING THE PURCHASE OF A PORTION OF THE MISSOURI RIVER OVERLOOK SOUTH OF CULBERTSON IN ROOSEVELT COUNTY AND DESIGNATION OF THE OVERLOOK AS A REGION 6 STATE PARK; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE."
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:
NEW SECTION. Section 1. Acquisition of Culbertson overlook property -- state park designation. (1) The administrator of the parks division of the department of fish, wildlife, and parks, on behalf of the state, shall direct the purchase of the northeast corner portion of the Missouri River overlook, south of Culbertson, Montana, and adjacent to Highway 16 in Roosevelt County in northeastern Montana, including necessary rights-of-way to ensure public access to the property, if and when the property is available, using any department funds available for the purchase of land and access for state parks. Not more than $1 million may be spent from state park funds to complete the purchase.
(2) Sufficient property must be purchased to provide for an overlook viewing platform and parking for four to six vehicles. The department shall install adequate fencing around the property to ensure the privacy of adjoining landowners and to discourage trespass onto adjoining private property. Appropriate signage must be installed to inform the traveling public of the geological, cultural, and historical significance of the area.
(3) When the Culbertson overlook property purchase directed in subsection (1) is completed and clear title for the property, including public access, resides with the state, the department shall designate the property as a region 6 state park and make necessary improvements to the property to ensure safe public use and perpetual enjoyment.
NEW SECTION. Section 2. Effective date. [This act] is effective on passage and approval.
