A BILL FOR AN ACT ENTITLED: "AN ACT PROHIBITING A VEHICLE TOWING ANOTHER VEHICLE ON A TWO-LANE HIGHWAY FROM FOLLOWING TOO CLOSELY TO A SIMILAR VEHICLE DURING TIMES OF HAZARDOUS DRIVING CONDITIONS; AND AMENDING SECTION 61-8-329, MCA."
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:
Section 1. Section 61-8-329, MCA, is amended to read:
"61-8-329. Following too closely. (1) The driver of a motor vehicle may not follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of the vehicles and the traffic upon and the condition of the roadway.
(2) A Except as provided in subsection (3), a motor vehicle being driven upon a roadway outside of a business or residence district, including in a caravan or motorcade, whether or not towing other vehicles, must be operated in a manner that allows sufficient space between each vehicle or combination of vehicles to enable any other vehicle to enter and occupy the space without danger. This provision does not apply to funeral processions.
(3) A truck tractor, truck, or motor vehicle towing another vehicle and traveling on a two-lane highway outside of a business or residence district when snow or rain creates hazardous travel conditions may not follow closer than 1,200 feet behind another truck tractor, truck, or motor vehicle towing another vehicle."
