A BILL FOR AN ACT ENTITLED: "AN ACT SUBMITTING TO THE QUALIFIED ELECTORS OF MONTANA AN AMENDMENT TO ARTICLE II OF THE MONTANA CONSTITUTION PROVIDING FOR THE RIGHT TO QUALITY HEALTH CARE REGARDLESS OF ABILITY TO PAY; AND PROVIDING A DELAYED EFFECTIVE DATE."
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:
NEW SECTION. Section 1. Article II of The Constitution of the State of Montana is amended by adding a new section 36 that reads:
Section 36. Right to health care. It is the goal of the people and the duty of the legislature to establish a comprehensive system of quality health care that is accessible to each person regardless of ability to pay, includes all reasonable and necessary preventive, remedial, rehabilitative, and palliative care, and affords each person an equal opportunity to exercise the inalienable right to the highest attainable standard of health. The right to health and health care recognized in this section shall be self-executing.
NEW SECTION. Section 2. Effective date. If approved by the electorate, this amendment is effective January 1, 2011.
NEW SECTION. Section 3. Submission to electorate. This amendment shall be submitted to the qualified electors of Montana at the general election to be held in November 2010 by printing on the ballot the full title of this act and the following:
[] FOR providing that every Montanan has a right to quality health care regardless of ability to pay.
[] AGAINST providing that every Montanan has a right to quality health care regardless of ability to pay.
