A BILL FOR AN ACT ENTITLED: "AN ACT CREATING A PERMANENT OVERSIGHT COMMITTEE ON CORRECTIONS; APPROPRIATING MONEY TO THE LEGISLATIVE SERVICES DIVISION FOR ADMINISTRATION OF THE COMMITTEE; AND PROVIDING AN EFFECTIVE DATE."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     NEW SECTION.  Section 1.  Oversight committee on corrections. (1) There is an oversight committee on corrections. The oversight committee is composed of eight members who are appointed as follows:

     (a)  four members of the house of representatives, not more than two of whom may be from one political party, appointed by the speaker of the house; and

     (b) four members of the senate, not more than two of whom may be from one political party, appointed by the committee on committees.

     (2)  The members appointed under subsection (1) must include at least one representative from the house appropriations subcommittee on institutions, one senator from the senate finance and claims subcommittee on institutions, and one member of the legislative audit committee.

     (3)  In case of a vacancy, a replacement must be selected in the manner of the original appointment.

     (4)  Members are entitled to salary and expenses as provided in 5-2-302.

     (5)  The oversight committee may request staff assistance from the legislative services division, the legislative fiscal division, and the legislative audit division, which assistance may be provided within limits established by the appropriate legislative committee, given other priorities and responsibilities.

     (6)  The legislative services division has the same authority of investigation and examination as it has for other committees under 5-11-106, and the legislative council has the same authority to hold hearings on behalf of the oversight committee as it has for other committees under 5-11-107.

     (7) Each state agency or contractor that provides services or funding for a program or service for adult or juvenile corrections shall provide assistance and information upon request of the oversight committee.



     NEW SECTION.  Section 2.  Duties of oversight committee. The oversight committee's duties include but are not limited to inquiry into and oversight of:

     (1) the department of corrections' budget;

     (2) the department of corrections' administration and operation of correctional programs and facilities;

     (3) contracts for correctional services and programs for adults and juveniles, including private prisons, regional correctional facilities, prerelease centers, residential placements, and medical services;

     (4) the conditions of confinement in any correctional facility in which persons under the custody of the department of corrections are placed;

     (5) program evaluation of any correctional program;

     (6) population projection methodology;

     (7) correctional databases and management information systems and their integration with other federal, state, and local government agencies;

     (8) the impact of legislative proposals on correctional populations;

     (9) sentencing statutes and criminal procedure in Titles 45 and 46;

     (10) correctional statutes provided for in Title 53, chapter 30; and

     (11) provisions regarding juveniles in Title 41, chapter 5.



     NEW SECTION.  Section 3.  Appropriation. There is appropriated $125,000 from the general fund to the legislative services division for the administration and support of the oversight committee on corrections.



     NEW SECTION.  Section 4.  Codification instruction. [Sections 1 and 2] are intended to be codified as an integral part of Title 5, and the provisions of Title 5 apply to [sections 1 and 2].



     NEW SECTION.  Section 5.  Effective date. [This act] is effective July 1, 1999.
