A BILL FOR AN ACT ENTITLED: "AN ACT REQUIRING PUBLIC AGENCIES TO MAKE AVAILABLE TO BIDDERS OR POTENTIAL BIDDERS DOCUMENTS REFERENCED IN BID SPECIFICATIONS FOR PUBLIC CONSTRUCTION CONTRACTS."
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:
NEW SECTION. Section 1. Referenced documents to be made available for public construction contracting -- definition. (1) A public agency letting a public construction contract shall make available to a bidder or potential bidder documents referenced in the bid specifications. The documents must be made available at no charge and upon request by no later than 7 working days prior to the bid opening.
(2) A public agency may not award a construction contract if the agency has failed to comply with the provisions of this section.
(3) For the purposes of this section, "construction" means any type of construction that may be performed by a public contractor, including "construction services" or a "public works contract" as those terms are defined in 18-2-401.
NEW SECTION. Section 2. Saving clause. [This act] does not affect rights and duties that matured, penalties that were incurred, or proceedings that were begun before [the effective date of this act].
NEW SECTION. Section 3. Codification instruction. [Section 1] is intended to be codified as an integral part of Title 18, chapter 1, and the provisions of Title 18, chapter 1, apply to [section 1].
