A BILL FOR AN ACT ENTITLED: "AN ACT ALLOWING A COUNTY OR MUNICIPALITY TO SET LESS RESTRICTIVE CLOSING HOURS FOR ESTABLISHMENTS WITH ALL-BEVERAGES LIQUOR LICENSES THAT HAVE CATERING ENDORSEMENTS; PROVIDING THAT ALCOHOL SALES MUST BE LIMITED TO ON-PREMISES CONSUMPTION; PROVIDING THAT THE MINIMUM CLOSING HOURS FOR THOSE ESTABLISHMENTS BE FROM 4 A.M. TO 8 A.M.; AND AMENDING SECTION 16-3-304, MCA."
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:
Section 1. Section 16-3-304, MCA, is amended to read:
"16-3-304. Closing hours for licensed retail establishments. (1) Except as provided in 16-3-305, all licensed
establishments wherein where alcoholic beverages are sold, offered for sale, or given away at retail shall must be closed
during certain hours each day. Except as provided in subsection (2), the establishment must be closed between 2 a.m. and 8
a.m.; provided, however,
(2) (a) that when any municipal incorporation has A municipality may by ordinance further restricted restrict the hours of
sale of alcoholic beverages, then the sale of alcoholic beverages is prohibited within the limits of any such city or town during
the time such sale is prohibited by this code and in addition thereto during the hours that it is prohibited by such ordinance.
(b) A county or a municipality may provide for hours of closure for certain establishments that are less restrictive than the time provided in subsection (1) for on-premises consumption of alcoholic beverages. To be authorized for less restrictive hours, the establishments shall possess both an all-beverages license and a catering endorsement to the all-beverages license. The less restrictive closing hours must require the establishment to be closed at least between the hours of 4 a.m. and 8 a.m.
(3) During such the hours that an establishment must be closed as provided by law and ordinance, all persons except the
alcoholic beverage licensee and employees of such the licensed establishment shall must be excluded from the licensed
premises."
