A BILL FOR AN ACT ENTITLED: "AN ACT REQUIRING A REPORT FOR IMPROVING AND STREAMLINING THE IMPLEMENTATION OF THE MONTANA ENVIRONMENTAL POLICY ACT; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE AND A TERMINATION DATE."
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:
NEW SECTION. Section 1. Report. (1) The departments of environmental quality; fish, wildlife, and parks; natural resources and conservation; and transportation shall prepare and present a report to the 57th legislature with recommendations for improving and streamlining the implementation of the Montana Environmental Policy Act.
(2) (a) The department of environmental quality shall establish a collaborative group of not more than 20 persons representing a broad spectrum of interests affected by the implementation of Title 75, chapter 1, parts 1 and 2. The following individuals or entities must be represented in the collaborative group:
(i) industries regulated or affected by the implementation of departmental regulations that trigger Title 75, chapter 1, part 2;
(ii) citizen groups; and
(iii) legislative agencies.
(b) Federal agencies may be invited to participate in the collaborative group.
(3) The collaborative group shall:
(a) consider a broad range of issues and concerns in reforming the implementation of Title 75, chapter 1, parts 1 and 2; and
(b) identify potential recommendations for improving and streamlining the implementation of Title 75, chapter 1, parts 1 and 2, while ensuring informed decisionmaking and public involvement.
(4) The department of environmental quality shall contract with a facilitator who is not an employee of the departments described in subsection (1) to facilitate the discussions of the collaborative group and to expedite the development of the report required in subsection (1).
NEW SECTION. Section 2. Effective date. [This act] is effective on passage and approval.
NEW SECTION. Section 3. Termination. [This act] terminates December 31, 2000.
